Terms of Service

These Terms of Service ("Terms") govern your access to and use of Vantaj, an uptime and infrastructure monitoring service operated by Vantaj ("we," "us," or "our"), available at app.vantaj.co and vantaj.co (collectively, the "Service").

By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

1. The Service

Vantaj provides uptime monitoring, incident alerting, heartbeat tracking, domain expiry tracking, and public status pages for websites and infrastructure. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practical.

2. Accounts

Registration

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

Workspaces and teams

Your account belongs to a workspace. You may invite other users to your workspace. Each member you invite must also agree to these Terms. You are responsible for the actions of members you invite.

Account termination

You may delete your account at any time from the Settings page. We may suspend or terminate your account if you violate these Terms or engage in activity that harms the Service or other users.

3. Acceptable Use

You agree not to use the Service to:

  • Monitor endpoints or services you do not own or have explicit permission to monitor
  • Conduct denial-of-service attacks or deliberately overload third-party infrastructure through monitoring activity
  • Scrape, reverse engineer, or attempt to extract the source code or underlying data of the Service
  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Resell or sublicense access to the Service without our written permission

We reserve the right to investigate suspected violations and suspend or terminate accounts accordingly.

4. Subscriptions and Payment

Plans

Vantaj offers free and paid subscription plans. The features available to you depend on your current plan. Paid plans are billed in advance on a monthly or annual basis.

Payment

Paid plans are processed through our payment provider. By subscribing, you authorize us to charge your payment method on a recurring basis. All fees are non-refundable except as required by law or as stated in our refund policy.

Plan changes

You may upgrade or downgrade your plan at any time. Upgrades take effect immediately and are prorated. Downgrades take effect at the end of your current billing period.

Failed payments

If a payment fails, we will attempt to retry the charge. If payment is not received within a grace period, your account may be downgraded to the free plan or suspended until payment is resolved.

5. Refund Policy

We offer a 14-day refund on any paid subscription. If you are not satisfied within the first 14 days of a payment, contact us at [email protected] and we will issue a full refund - no questions asked.

6. Free Plan Limits

The free plan is provided at our discretion and may be modified or discontinued. We reserve the right to enforce usage limits on the free plan to protect service quality for all users. Excessive use inconsistent with normal personal or small-team use may result in throttling or suspension.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We process your data as described therein to provide and improve the Service.

Your data

You retain ownership of all monitoring configurations, incident data, and other content you create. By using the Service, you grant us a limited license to store, process, and transmit that data solely to provide the Service.

Data retention

Check history and incident data is retained for up to 90 days on the free plan and up to 1 year on paid plans. When you delete your account, your data is deleted within 30 days except where retention is required by law.

7. Service Availability

We strive to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service is provided "as is" and "as available." We are not liable for any losses caused by Service downtime, missed alerts, false positives, or delayed notifications.

Vantaj is a monitoring tool - it reports on the status of the services you configure. It is not a substitute for your own operational practices, redundancy, or incident response procedures.

8. Intellectual Property

The Service, including its design, code, branding, and documentation, is owned by Vantaj and protected by intellectual property laws. These Terms do not grant you any rights to use our trademarks, logos, or branding.

Feedback, suggestions, or ideas you share with us may be used by us without obligation or compensation to you.

9. Limitation of Liability

To the fullest extent permitted by law, Vantaj and its officers, employees, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business, arising from your use of or inability to use the Service.

Our total liability to you for any claim arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless Vantaj and its affiliates from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

11. Modifications to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or via a prominent notice in the dashboard at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service will be resolved through good-faith negotiation first, and if unresolved, through binding arbitration or the courts of the jurisdiction in which Vantaj operates.
